1. Introduction and Acceptance of Terms

These Terms and Conditions of Service (the "Agreement") constitute a legally binding contract between 613 Home Services Inc. ("613 Home Services," "we," "our," or "us"), owned and operated by Jamie Roussel and Luca, and you, the client ("Client," "you," or "your"), governing the provision of home services performed by 613 Home Services Inc.

By requesting a quote, booking a service, signing a work order, or permitting our personnel to attend your property, you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety. If you do not agree with any provision of this Agreement, you must not engage our services.


2. Definitions

For the purposes of this Agreement:

"Services" means any and all home services provided by 613 Home Services Inc., including but not limited to cleaning, maintenance, repair, renovation, installation, inspection, and any other residential or commercial property services.

"Work Order" means any written or electronic document, quote, invoice, or service confirmation issued by 613 Home Services Inc. describing the scope, price, and schedule of Services to be performed.

"Property" means the residential or commercial premises at which the Services are to be performed, as identified in the applicable Work Order.

"Subcontractor" means any licensed third-party trade professional engaged by 613 Home Services Inc. to assist in the delivery of Services.


3. Scope of Services

Services will be performed as described in the applicable Work Order. Any changes to the agreed scope of work — including additions, deletions, or modifications — must be agreed upon in writing by both parties prior to commencement of the additional or modified work. Verbal authorizations for scope changes are not binding on 613 Home Services Inc. unless subsequently confirmed in writing.

We reserve the right to decline, suspend, or discontinue any Services at our sole discretion, including where site conditions are deemed unsafe, where access to the Property is obstructed, or where the Client has breached any provision of this Agreement.


4. Quotes and Estimates

All quotes and estimates provided by 613 Home Services Inc. are based on information available at the time of assessment and are valid for thirty (30) days from the date of issuance unless otherwise stated. Quotes are not guarantees of final cost. Final pricing may vary where:

Hidden conditions are discovered upon commencement of work (e.g., structural deficiencies, mold, pest damage, or non-standard materials);

The Client requests changes to the agreed scope of work;

Material or labour costs increase due to circumstances beyond our reasonable control; or

Conditions at the Property differ materially from those represented by the Client at the time of quoting.

Where additional costs are anticipated to exceed fifteen percent (15%) of the original quote, we will notify the Client and obtain approval before proceeding.


5. Scheduling and Access

a) Appointments The Client agrees to make the Property reasonably accessible to our personnel at the scheduled service time. Where access is not available within thirty (30) minutes of the scheduled start time, 613 Home Services Inc. reserves the right to treat the appointment as a cancellation and apply the applicable cancellation fee set out in Section 6.

b) Access Requirements The Client is responsible for ensuring that our personnel have safe and unobstructed access to all areas of the Property required to perform the Services. The Client must disclose any known hazards, restricted areas, pets, security systems, or access conditions prior to the scheduled appointment.

c) Rescheduling We will make reasonable efforts to accommodate scheduling changes requested by the Client. Rescheduling requests made with less than forty-eight (48) hours' notice may be subject to a rescheduling fee.


6. Cancellation Policy

We understand that circumstances change. The following cancellation terms apply:

Cancellations made more than forty-eight (48) hours before the scheduled appointment: No charge.

Cancellations made between twenty-four (24) and forty-eight (48) hours before the scheduled appointment: A fee equal to twenty-five percent (25%) of the quoted service value may apply.

Cancellations made with less than twenty-four (24) hours' notice, or failure to provide access at the time of the appointment: A fee equal to fifty percent (50%) of the quoted service value will apply.

Cancellation fees exist to compensate our team for reserved time and declined alternative bookings. We appreciate your understanding and respect for our scheduling commitments.


7. Payment Terms

a) Invoicing Unless otherwise agreed in writing, payment is due in full upon completion of Services. For larger projects, we may require a deposit of up to fifty percent (50%) of the total quoted value prior to commencement of work, with the balance due upon completion.

b) Accepted Payment Methods We accept payment by e-transfer, credit card, cheque, or such other methods as may be agreed upon. All amounts are in Canadian dollars unless otherwise specified.

c) Late Payment Invoices not paid within fourteen (14) days of the due date will be subject to interest charges at the rate of two percent (2%) per month (24% per annum) on the outstanding balance, compounded monthly. We reserve the right to suspend or refuse future services to any Client with an outstanding overdue balance.

d) Disputed Invoices If you believe an invoice contains an error, you must notify us in writing within seven (7) days of receipt. Undisputed portions of an invoice remain due and payable by the original due date.

e) Collections In the event that an outstanding balance is referred to a collections agency or legal counsel for recovery, the Client shall be responsible for all reasonable costs of collection, including legal fees on a substantial indemnity basis.


8. Client Responsibilities

The Client agrees to:

Provide accurate and complete information regarding the Property and the nature of the work required;

Disclose any known structural issues, hazardous materials (including asbestos, lead paint, or mold), or conditions that may affect the safety of our personnel;

Ensure that all persons and animals are clear of work areas during the performance of Services;

Obtain any permits, approvals, or consents required by municipal or provincial authorities in connection with the Services, unless otherwise expressly agreed in writing that 613 Home Services Inc. will obtain such permits on the Client's behalf;

Secure or remove any fragile, valuable, or sentimental items from work areas prior to commencement of Services; and

Provide a safe working environment in compliance with applicable occupational health and safety legislation.

Failure to meet these responsibilities may result in delays, additional charges, or suspension of Services, for which 613 Home Services Inc. shall bear no liability.


9. Warranties and Representations

a) Workmanship Warranty 613 Home Services Inc. warrants that all Services will be performed in a professional and workmanlike manner, consistent with industry standards. Where a deficiency in workmanship is identified and reported to us within thirty (30) days of service completion, we will return to remedy the deficiency at no additional cost to the Client, provided the deficiency is not attributable to Client misuse, pre-existing conditions, or third-party interference.

b) Materials and Products Where materials or products are supplied by 613 Home Services Inc., those materials will be of reasonable quality and fit for their intended purpose. Manufacturer warranties, where applicable, will be passed through to the Client to the extent permissible.

c) No Guarantee of Outcome Certain Services, by their nature, cannot guarantee a specific outcome (e.g., pest control, remediation, or cosmetic restoration of aged materials). We will clearly communicate any such limitations in the applicable Work Order.

d) Client-Supplied Materials We do not warrant the performance or suitability of any materials supplied by the Client. Where Client-supplied materials prove defective or unsuitable, any additional labour required to remedy the issue will be billed at our standard rates.


10. Limitation of Liability

To the maximum extent permitted by applicable law:

a) The total liability of 613 Home Services Inc. to the Client for any claim arising out of or in connection with the Services shall not exceed the total amount paid by the Client for the specific Services giving rise to the claim.

b) 613 Home Services Inc. shall not be liable for any indirect, consequential, incidental, special, or punitive damages, including loss of income, loss of use, or loss of data, even if advised of the possibility of such damages.

c) We are not liable for pre-existing conditions, latent defects, or damage to areas of the Property that were not part of the agreed scope of Services.

d) We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including severe weather, natural disasters, supply chain disruptions, labour disputes, or government-mandated restrictions.

Nothing in this Agreement limits or excludes liability that cannot be limited or excluded under applicable Canadian law.


11. Insurance

613 Home Services Inc. maintains general commercial liability insurance and, where applicable, workers' compensation coverage for our employees. Certificates of insurance are available upon written request. The Client is encouraged to maintain their own property insurance covering the Property and its contents during the performance of any Services.


12. Subcontractors

We may engage licensed subcontractors to assist in the delivery of Services. All subcontractors engaged by 613 Home Services Inc. are required to maintain appropriate licensing and insurance. We remain responsible to the Client for the quality of work performed by our subcontractors as if such work were performed by our own employees.


13. Photographs and Documentation

613 Home Services Inc. may take photographs or video recordings of the Property before, during, and after the performance of Services for documentation, quality assurance, and warranty purposes. Such materials are treated as confidential and are not shared publicly without your express written consent, except as required for internal business purposes or legal proceedings.


14. Dispute Resolution

In the event of a dispute arising from or related to this Agreement or the Services provided, the parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved informally within thirty (30) days, the parties agree to pursue mediation before initiating any formal legal proceedings. The costs of mediation shall be shared equally between the parties unless otherwise ordered.

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. The parties irrevocably submit to the exclusive jurisdiction of the courts of Ontario for the resolution of any dispute not resolved through negotiation or mediation.


15. Privacy

The collection, use, and disclosure of your personal information in connection with the Services is governed by our Privacy Policy, which is incorporated by reference into this Agreement and available upon request at [email protected].


16. Amendments

613 Home Services Inc. reserves the right to amend these Terms and Conditions at any time. Updated terms will be communicated to existing clients via email and will apply to all Services booked after the date of the update. Your continued engagement of our Services following notice of any amendment constitutes your acceptance of the revised terms.


17. Severability

If any provision of this Agreement is found to be invalid, unlawful, or unenforceable under applicable law, such provision shall be severed from this Agreement, and the remaining provisions shall continue in full force and effect.


18. Entire Agreement

This Agreement, together with any applicable Work Order and our Privacy Policy, constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations, representations, warranties, and understandings, whether written or oral. No waiver of any provision of this Agreement shall be effective unless made in writing and signed by an authorized representative of 613 Home Services Inc.
